Kratom trade brief, 12-18 September 2026: the 7-OH comment record, and enforcement moves to the city line
No new federal scheduling order landed between 12 and 18 September 2026, but the week filled in two pictures that matter to anyone shipping kratom into the United States: what the now-closed 7-OH docket actually contains, and how far down the jurisdictional ladder American enforcement has travelled. A peer-reviewed propagation study published mid-week also put a marker down on where kratom alkaloids might one day be grown. Each carries a different instruction for buyers purchasing at volume.
What the 7-OH comment record contains, and the prong that bites finished goods
The comment window on docket HHS-OASH-2026-0232 closed on 10 September. On 15 September, Pain News Network reported that the docket had drawn close to 36,000 comments in total, with more than 3,000 filed during the 15-day extension alone, and that almost all of the late filings opposed a limit of 1 milligram of 7-hydroxymitragynine per tablet. Those figures are the outlet's tally; the agencies have not published a count of their own.
The number being argued over comes from the July request for information, which set the specified threshold in two parts. Botanical material of Mitragyna speciosa falls inside the temporary Schedule I placement above 0.050 percent 7-OH on a dry weight basis. Other material falls inside it above 0.050 percent weight/weight, weight/volume or volume/volume, or above 1.00 milligram of 7-OH in the article.
Why it matters to the trade. The second prong is the one most often misread. It is a per-unit test, not a concentration test. Bulk material sitting comfortably below 0.050 percent can still yield a finished article above 1.00 milligram if the serving size is large enough, so material that passes on percentage can still fail on the unit. Concentration compliance and unit compliance are separate calculations, and the second is controlled by whoever sets the dose format, which is the brand manufacturer rather than the supplier of the raw material.

Our extract is standardised on mitragynine, which is a different specification axis from 7-OH, so a manufacturer formulating against a per-unit ceiling needs both numbers for the input material before fixing a capsule or sachet weight. Ask for the figures at the specification stage and run the per-serving arithmetic before the format is locked, not after the tooling is ordered.
US enforcement moves to the city and county line
Two local actions in the same week showed where American enforcement risk now sits. In Tupelo, Mississippi, police began enforcing a municipal kratom ordinance at 10am on Saturday 12 September. The city council passed the ordinance in February 2026 and a legal challenge delayed it; Police Chief John Quaka said the goal was voluntary compliance and that businesses were given 48 hours' notice, as reported by WTVA and WCBI on 10 September.
In Lincoln County, Tennessee, WAFF reported on 11 September that the sheriff's office seized kratom from 21 businesses, describing tens of thousands of dollars of merchandise removed, with the district attorney's office weighing whether charges follow. Tennessee's statewide prohibition took effect on 1 July 2026, and Metro Nashville's Beer Permit Board notice records the sale of kratom as a Class C felony under it. The seizure figures come from WAFF's reporting; the sheriff's office has not published an account of its own.
Why it matters to the trade. A state-level legality map is no longer adequate diligence for a US distribution plan. A municipal ordinance can close a city while the surrounding state remains open, and the date enforcement actually begins can be set by a police chief rather than a legislature. Buyers should take their own legal advice on each destination jurisdiction; nothing here is legal advice, and the position moves week to week.

New propagation research, and what it does not change about supply
A study from researchers at the University of Victoria, the BC Institute of Technology, the University of Illinois Chicago and the University of the Fraser Valley was published in Pharmaceutical Biology on 12 September and indexed on PubMed. Working from the observation that commercial kratom plant material is scarce in North America, and that propagation there relies mainly on relatively inefficient shoot cuttings, the authors used a design-of-experiments approach to optimise an in vitro shoot induction system, then compared metabolite profiles by UPLC-MS/MS. They reported no significant difference in quantified mitragynine, melatonin and some related metabolites between in vitro and greenhouse-grown plants under the study's conditions.
Why it matters to the trade. This is a laboratory propagation result rather than a commercial supply development, and the paper does not claim otherwise. Read as a market signal, it points to sustained research interest in producing kratom alkaloids away from the traditional growing regions, with North American material scarcity as the stated motivation. On any near-term buying horizon it changes nothing: commercial-volume material remains field-grown agriculture in Southeast Asia. We recorded no new Thai export, licensing or advertising changes in the 12 to 18 September window.
